Why an attorney at all?

Urban renewal is a welcome decision that brings renewal, prosperity and security. But it is a transaction over your home. Do the checks, consult experts, hear from friends and neighbors who've been through it — and still, all that knowledge won't give you the full picture of the many details a renewal deal demands. To protect your rights through the whole journey, you equip yourselves with an attorney who specializes in the field, is seasoned in practice, knows the market's innovations, knows how to anchor your rights in efficient and safe mechanisms — and can make the connections needed among the owners themselves, and with the developer.

This attorney will walk with you for years. Choose one you feel connected to — who cares about you and understands you, whom you trust, who listens, who is available, whom you're comfortable calling about anything, whenever you need. One who is there for you.

The owners' attorney — the role

  • Accompanying the owners in selecting an engineering supervisor and further advisers.
  • Participating in owners' meetings.
  • Shaping the approach to developers and the criteria for choosing the right one.
  • Negotiating the developer agreement — maximizing compensation, securing guarantees and collateral, fixing timelines.
  • Comparing developer bids, accompanying the selection and the contract.
  • Holding and releasing the developer's guarantees in trust as the project advances.
  • Updating owners on progress, monitoring the developer's compliance with the agreement, and handling legal issues as they arise.

When to choose?

The process touches the most essential thing in our lives — home. To protect the owners' interests and avoid fouls that can hurt the compensation or the timeline, appoint the owners' attorney from the very first moment the decision to renew is made — and before signing anything with anyone involved in the process.

What to examine?

  • Experience accompanying renewal projects — concrete examples and recommending residents.
  • The full service basket (owners' meetings, appointing the representation, developer-contract negotiation, guidance to owners, holding the guarantees and powers of attorney, planning-stage accompaniment) — and to what stage the counsel runs (occupancy, registration of the owners' rights, and beyond).
  • Who actually delivers the service — larger firms employ many attorneys; verify who will be in direct contact with the owners.

Tip: an attorney offering more than the standard? Write the added value down.

How to choose?

The elected representation approaches attorneys with expertise in real estate generally and in representing owners in urban renewal specifically — recommendations from friends, neighbors and owners in active projects help. The representation meets each candidate to test the fit, then chooses the one who will lead them through every stage of execution, to the key of the new apartment and its registration in their name.

Who pays?

The engagement is anchored in a written, detailed agreement covering the attorney's roles, the fee, and payment milestones. The developer chosen by the owners' representation bears the full fee of the owners' attorney. A further tip: make sure the fee milestones spread proportionally across the project's life — preserving the attorney's commitment through delivery of the key and registration of the new building in your name. Generally, owners pay nothing out of pocket for the renewal process (unless they choose upgrades — a floor, a spec — directly with the developer).
